These Terms of Service ("Terms") govern your access to and use of AutoClaw, an AI-powered marketing automation platform operated by JY Tech ("we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using AutoClaw, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using AutoClaw on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
AutoClaw provides AI-powered marketing automation services including but not limited to: • AI-driven content generation and scheduling • Social media management and publishing (X/Twitter, TikTok, and other platforms) • Video generation and media processing • Analytics and engagement tracking • Email marketing automation • SEO content optimization • Lead prospecting and sales tools
3. User Accounts & API Keys
You are responsible for maintaining the confidentiality of your account credentials and any third-party API keys you provide through our Bring Your Own Key (BYOK) system. You are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Data Collection & Usage
By using our services, you agree that your posting data, engagement metrics, content performance data, and usage patterns may be stored and used for the following purposes: • Providing and operating the services you have requested • Business analytics and platform performance monitoring • Service improvement and feature development • Platform optimization and reliability improvements • Generating aggregated, anonymized insights for service enhancement For free-tier users, aggregated and anonymized data may be used to improve our AI models and platform capabilities. Individual data is never sold to third parties.
5. Paid Plan Data Confidentiality
Paid plan users receive enhanced data protection: • Your business data is kept strictly confidential • Your content, analytics, and engagement data will not be shared with third parties • Your data will not be used for purposes beyond your own account analytics and service delivery • Your data will not be used to train or improve AI models shared with other users • You may request full data export or deletion at any time This confidentiality commitment remains in effect for the duration of your paid subscription and for 30 days following cancellation.
6. Intellectual Property
You retain ownership of all content you create, upload, or publish through AutoClaw. By using our services, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the services. AI-generated content created through our platform is owned by you, subject to any third-party terms from underlying AI providers (e.g., OpenAI, Anthropic).
7. Prohibited Uses
You agree not to use AutoClaw to: • Violate any applicable laws or regulations • Infringe on intellectual property rights of others • Distribute spam, malware, or harmful content • Engage in deceptive practices or impersonation • Attempt to gain unauthorized access to our systems • Circumvent rate limits or abuse API integrations • Use the platform for any illegal or fraudulent activities
8. Termination
We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time. Upon termination, your data will be retained for 30 days to allow for export, after which it will be permanently deleted unless retention is required by law.
9. Disclaimer & Limitation of Liability
AutoClaw is provided "as is" without warranties of any kind. We do not guarantee that third-party integrations (social media platforms, AI providers, etc.) will be available or function without interruption. We are not liable for any content posted through our platform to third-party services. Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through our platform. Continued use of our services after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your account.
